No one was injured in the incident.
Joshua Terry James, 27, of Winona was charged Monday with ineligible possession of a firearm and felon in possession of a firearm. If convicted, James faces a mandatory minimum five years in prison, Assistant Winona County Attorney Kevin O’Laughlin said.
Eddie Lamorris Jones, 23, of Winona is in the Winona County Jail, awaiting charges he violated his probation. Jones is on probation for felony domestic assault by strangulation and assault causing substantial harm. When encountered Saturday, Jones appeared “under the influence” of something but passed a portable breath test, according to police. Jones tested positive for marijuana in a urine test at the jail, Deputy Chief Tom Williams said.
Julius Lee Jones, 19, of Riverdale, Ill., was ticketed for underage drinking and released. It was unclear in the police reports if he was related to Eddie Jones.
According to police reports, officers were dispatched at 1:12 a.m. Saturday to Maplewood Townhomes at the intersection of U.S. Highway 61 and Pelzer Street on a report of people yelling and several gunshots fired. Upon arrival, officers discovered no one was hurt and obtained descriptions of three men thought to have done the shooting.
Another caller reported three men walking the area of Fifth and Otis streets and saw one of them throw something to the ground near a tree and a fence, Williams said. He said the descriptions were the same as in the shooting incident and officers moved into the area.
Officers took all three men into custody and also found two discarded handguns. According to the report, one was a .38-caliber Smith & Wesson handgun loaded with five rounds. The other, a .38-caliber Charter Arms revolver, was loaded with five spent rounds and smelled of burnt gunpowder, Williams said. He said both weapons had been reported stolen out of Rochester, Minn., in July.
O’Laughlin said James was also found to have eight rounds of ammunition identical to those that had appeared to have been fired from the Charter Arms revolver.
Bail was set at $100,000 for James, who is currently on probation for motor vehicle theft, damage to property and drunken driving. A probation violation report is likely to follow, O’Laughlin said, because James was not to use alcohol while on probation, but a portable breath test found his blood-alcohol concentration to be 0.11 percent.
James admitted in court Monday that he was “really intoxicated” Saturday and could only really remember people yelling, “Get the h— out of here.”
He is scheduled to return to court Oct. 23.
