Three sought in thefts from rental store

Arrest warrants have been issued for three people accused of absconding with merchandise from a local rent-to-own store.

Unrelated felony theft complaints were filed Nov. 29 in Winona County District Court against Kristie Sue Nelson, 37, Quinton Louis Cole, 32, and Nakeya Shanee Banks, 22. None of them had verifiable addresses and each was charged with felony theft of property worth more than $500 but less than $2,500.
They face up to a maximum penalty of five years in prison and a $10,000 fine.

According to the complaint against Nelson, on Dec. 29, 2006, she rented an eMachines computer worth $1,111.14 from 1st Choice — formerly known as Lebakkens Rent to Own. When she failed to make a payment in March, the store owner, Mike Lebakken, tried to track her down. Nelson’s landlord went into her apartment at 450 E. Wabasha St. and found abandoned property, including furniture rented from 1st Choice, but no computer.

Cole rented a computer package including a monitor, speakers, a mouse and other items worth $1,130.58, according to the complaint against him. A 1st Choice employee saw a moving van in front of Cole’s residence, but his girlfriend said they were just helping a neighbor move. Lebakken called Cole, who said he was helping move his girlfriend to Chicago. Cole also told the owner, “I give you my word as a man that I am not moving.”

An hour later, Lebakken stopped by Cole’s residence and found it cleared out. Cole and the computer equipment were gone.

Banks is accused of renting a washer, dryer, sofa, loveseat and rug in February and March 2006. When she failed to make a payment or return the merchandise in June, she was discovered to have moved without informing the store. It will cost 1st Choice $847.78 to replace the items Banks rented.

Lebakken said thefts of rented merchandise don’t really affect his business. He said the items are insured and he usually just writes them off unless the thieves are caught, prosecuted and ordered to pay restitution.

Lebakken said these types of thefts have only happened perhaps 10 times in the past couple of years.

" I just feel very judged in here simply because I'm from Chicago. How would you like it if you moved to Chicago and people there judged you negativity simply because you said you moved from Winona? Try being in my shoes and quit being so harsh to newcomers. I work hard, play hard, and make differences through compassion. " Ugina ~ People in Winona will not welcome you because until all the people from Chi moved here, we had a nice peaceful community. Not saying we didn't have drugs and fights etc, but we didn't have the crime, the amount of drugs, and we were a community where you knew everyone. I don't think people would have such a problem with Chi folks if they earned their keep, got "real" jobs (selling drugs is not a real job) and became productive members of our community. Anytime someone relocates to a new area, they miss the familiarity of home, so therefore relate "home" to nice/friendly/welcoming (because you already know a bunch of people) and the new place to unfriendly/unwelcoming simply because you're out of your comfort zone and away from the people you're accostomed to. Like the new kid in school...so quit judging Winona and take the situation in a realistic sense -- moving to a new town is hard and it's difficult to break into groups that are already established. " This is exactly the type of attitude I've noticed from natives of Winona. 'If you're not one of us than get out of our town'. I moved from Chicago because of my husband changing jobs and neither of us have felt welcomed into any clubs or groups. The second we say we moved from Chicago we get harrassed or reminded that we should stay out of trouble. My husband has one felony for drug abuse but has been clean for 9 years and I've been sober for 2 years. I learned alot in rehab and have since realized tolerance and understand of 'all' circumstances should be required of all citizens in my country. Be polite, be civil, stay straight. "

" I wouldn't be one bit offended by someone wishing me a Happy Hanukkah. I'm not Jewish, but if someone were to say that to me, I look at it as a cheerful greeting meant to bring joy. I personally choose not to be so oversensitive that I miss the real spirit of what is being said. I don't think I should be persecuted as a Christian because I wish someone a Merry Christmas, just as other religions shouldn't be persecuted for spreading their holiday cheer. That's just one man's opinion though. "

The law says "(9) leases or rents personal property under a written instrument and who: (i) with intent to place the property beyond the control of the lessor conceals or aids or abets the concealment of the property or any part thereof;" and also "or fails or refuses to return the property or pay the rental contract charges to lessor within five days after written demand for the return has been served personally in the manner provided for service of process of a civil action or sent by certified mail to the last known address of the lessee, whichever shall occur later, shall be evidence of intent to violate this clause." "

" Mike They are being charged with felony theft, not fraud. They also failed to inform the rental store of their move, which I am sure is part of their rental agreement. The fact that they are gone and the rental property is gone too pretty much indicates what their intentions were. "

We see Cole claimed he was not moving although one must wonder if that was done "in contracting said debt". There is nothing in this article to suggest either of the other two suspects committed any form of fraud. "
