Leonard Leroy Thielen of Stewartville, Minn., failed to abstain from drugs and alcohol and drove without a license and insurance, said Winona County Attorney Chuck MacLean.
Thielen also failed to maintain restitution payments to the victim’s family.
Judge Margaret Shaw Johnson converted payment to a civil judgment, which means the family can seek $13,416 of Thielen’s assets without having to file a lawsuit, MacLean said.
As of Friday, Thielen had paid $1,340 toward fines and restitution but still owed $15,169, court records showed. Thielen was transferred from the Winona County jail to the state prison in St. Cloud.
On April 26, 2003, Thielen was driving a motorcycle with a passenger, 38-year-old Lori Norris of Rochester, sitting behind him as part of the annual Flood Run motorcycle rally. Thielen rear-ended another motorcycle and Norris died at the scene. Thielen was under the influence of cocaine and he recovered from critical injuries.
Thielen pleaded guilty to criminal vehicular homicide in Winona County District Court and a judge sentenced him in October 2004 to 10 years of probation, suspended the prison sentence and fined him $3,065.
On Dec. 28, Thielen’s blood-alcohol content measured 0.03 percent and he had beer at home. On Jan. 21, he admitted to taking Seroquel — a drug used to treat schizophrenia and bipolar disorders — without a prescription, MacLean said.
Thielen will be eligible for release after three years, nine months in prison.
